Pay Protection, Rescheduling,
and Crew Compensation Timelines

All,

With all the recent cancellations, illegalities, and reschedules, I want to provide you with an overview of what to expect when these occur, and the timelines for Crew Compensation reviewing and adding the JCBA eligible pay protection to your schedule.

Cancellations/Crew Substitutions

All pay protection for canceled segments are reviewed by Crew Compensation at closeout by the 9th of the subsequent month. Should your sequence involve a canceled leg, you are pay protected for the greater of what you fly, or the scheduled time of the entire trip if another crew flies any portion of the sequence. If an XR appears on your schedule, that represents a partial cancellation. You are paid for the leg flown or scheduled to be flown by a substitute crew. The canceled portion is reviewed by Crew Compensation at closeout, and the applicable pay protection will then be added. If a leg in your sequence cancels or you become illegal, Crew Schedule may choose to split you back on the sequence when it passes back through base, or deadhead you to the next leg when you become legal. If you are deadheaded to catch up to the next leg, this is considered a reroute and not a reschedule.

Pay Protection Lost With ETB Trip

When you have any pay protection in place, if you pick up ETB flying on any CALENDAR day of the of your pay protection, you will forfeit the entire pay protection. If you intend to double dip, you may only pick up Company time from TTS or UBL. This can be a very costly mistake. Section 10.E.3.m. below is the applicable language.

“A Lineholder may conduct transactions that would result in actual flying on a day(s) pay protected by any other portion of Section 10. The Lineholder will receive pay and credit for such time.”

Entire Sequence Cancellations

When your entire sequence cancels and no other crew flies any leg contained in the sequence, you are removed unpaid unless it is the last trip/series of the month. The removal code indicated on your HI1 is (XI).

Last Series/ Last Trip Of The Month-Pay-Protection

Last Series/Last Trip of the Month Pay Protection (10.L.) is indicated on the HI1 with the word last. (see bottom picture below). If your Last Series of the Month runs consecutive with no days off in between, those sequences will be listed next to the word LAST on the HI1. Should any trip in that series cancel, or you become illegal, the LAST on your HI1 is replaced with the word LOCK. That means that pay protection has been applied to a trip in that series. This pay protection is auto-programmed to pay immediately and is coded (LS). Once the Lock has been applied, any subsequent ETB/TTS time added to the schedule will not be protected under this section. However, other pay protections in Section 10 still apply.

Direct Conflicts/FAR Illegal-Pay Protection

If you have a FAR removal (FI), you are paid for the full value of both sequences. For a Direct Conflict (DC), meaning a sequence overlaps another, the pay for the first trip measures against the second trip.

For example, you have two 10-hour trips back to back. You arrive a day later from your first trip which make you FAR Illegal (FI) for the second trip. Meaning you have less than eight hours between trips, and there is no overlap. The first trip is now worth 15 hours. You are pay protected for the full value (10 hours) of the second trip since they did not overlap. The pay value for both trips in this scenario is 25 hours.

In the case of a Direct Conflict (DC), you get in the next day causing a direct overlap with the second trip. The first trip becomes worth 15 hours, the second trip was worth 10 hours. The original scheduled value of both trips added together was 20 hours. You would be owed the difference of five hours in this scenario as a result of the trips overlapping. You are pay protected the original value of both.

Call Out Pay

If you are notified of a cancellation three hours or less before your report time and you have already left your residence, notify Crew Schedule that you are in route to the airport and have them add the three hours call out pay to your schedule. If the Scheduler does not add the time, ask to speak to the Senior on Duty. Crew Compensation will not process the claim. Call out pay must be added to your HI1 by the Crew Scheduler.

In addition, you are also entitled to mid-sequence call out pay if you report to the airport then return to the hotel. You will need to send a message to Crew Compensation via Direct Connect advising them you reported to the airport in mid-sequence then returned to the hotel. FOS will not populate mid-sequence call out pay unless the plane pushes off the gate. It will need to be manually added by Crew Compensation. Keep in mind that call out pay will measure against any generated RIG (pay and credit) time.

Rescheduling Rules

If your trip gets disrupted (e.g., misconnect, cancellation, etc.) and a reschedule is necessary, the company is required to attempt to notify you of changes to your schedule and you are required to remain available for a reschedule. Crew Scheduling will advise you of your adjusted sequence/assignment prior to four (4) hours after your originally scheduled sequence sign-in time or three (3) hours after the disruption is known, whichever is later. Positive contact is required.

If you have not been disrupted and a reschedule is necessary, the company must make positive contact with you through the approved methods (outlined in Section 10.V.5) to explain more about the adjustments made to your schedule.

Below are some key points to keep in mind if you are rescheduled.

Prior to report (10.J.2), my sequence was canceled in its entirety, what is Crew Scheduling’s obligation and what is mine?

Prior to report, you have no obligation to report for duty, regardless of whether Scheduling has notified you.

Prior to report (10.J.2), what should I do if I receive a communication (ONE message) or check Crew Portal and see my first flight or any flight of my sequence has canceled or been modified, and I haven’t been notified by Crew Scheduling?

If your sequence still has any active working or deadhead leg, you may still be subject to a reschedule and would still be required to report as originally scheduled.

If there is an adjustment to your sequence prior to report, Scheduling is required to contact you. If you notice an adjustment to your schedule before Scheduling has contacted you, you can proactively call Scheduling to receive your new sequence details. You may have the option to be removed from the sequence (10.J.2.b-c) and if you do not call or receive a call from Scheduling, you still are obligated to report to the airport at the original report time.

After report, but before departure (10.J.3), my sequence was modified or canceled, what are Crew Scheduling’s and my obligation?

Once you have reported for your sequence and your sequence experiences a disruption, Crew Scheduling has an obligation to notify you of the disruption and the subsequent reschedule. After the initial notification of your disruption, you will be advised of your adjusted sequence/assignment prior to four (4) hours after the originally scheduled sequence sign-in time or three (3) hours after the disruption is known, whichever is later. During this time, you should remain available at the airport during the timeframe listed above for your reschedule. If you have not heard anything and it’s nearing the end of the timeframe, please contact Crew Scheduling to receive information regarding your schedule. Scheduling may advise you of:

• A reschedule and the applicable details associated with the reschedule
• Release you from your duty day if you have flying on subsequent days
• Or, release you from your sequence with no further obligation

After report, but before departure (10.J.3), the first leg of my sequence has been canceled or my sequence has been canceled in its’ entirety and I’m unable to sign-in, what should I do?

If Crew Scheduling has not attempted to contact you, you should attempt to contact Crew Scheduling, but if you are unable to reach them, you should remain at the airport for up to four (4) hours from your originally scheduled sequence sign-in time or three (3) hours after the disruption is known, whichever is later, to be rescheduled. If you have not been contacted by Crew Scheduling during the aforementioned timeframe, please attempt to contact Crew Scheduling to see if you have been rescheduled or are released.

After origination, I experience a mid-sequence or end of sequence disruption (cancellation, delay, misconnect (10.J.4)), what should I do?

If Crew Tracking has not attempted to contact you and you have a mid-sequence disruption or the last leg(s) of your trip cancels (including if you are in your home base), you should contact Crew Tracking. You remain obligated to return the phone call and/or voicemail from Crew Tracking to be advised of your schedule. Rescheduled crews will be advised of their remaining duty assignment for that day and the balance of the sequence within three (3) hours after the disruption is known. If not assigned replacement flying within the three (3) hour timeframe, you will be released for that duty day.

What should I do if I receive a communication (ONE message) or check Crew Portal and see the first leg following an overnight has canceled and I haven’t been notified by Crew Scheduling (10.J.4)?

If Crew Tracking has not contacted you, you may contact Crew Tracking yourself to see if an update is available. If you’re unable to make positive contact with Crew Tracking, you need to report as originally scheduled. Crew Tracking will advise you of your repaired sequence as soon as possible. You are subject to a reschedule based on your original duty report time. Once you arrive at the airport, Crew Tracking must advise you of the balance of your sequence within three (3) hours. If they do not assign you replacement flying within the window above, you are be released for the rest of the duty day and may contact Hotel/Limo if rooms are required.
